Welcome to this months Hacienda Riquelme Resort-wide Owners newsletter.

We aim to continue to show the true state of affairs at the resort rather the ever positive gloss-over comments that come from the Committee.

This month we again focus on the Resort Debtors which are now at 1.5 million euros:

We are always amazed by the lack of open and honest communications from the Committee
 
This month we finally learn that NO UK debtor has ever had a court case raised anytime during the period 2008 to 2014!   
 
So much for previous Resort Presidents being hard on debtors!

At the same time we finally have confirmed by the Committee that a significant number of current debtors are not traceable! 
 
A matter that has taken 3 years to be confirmed in minutes!

Then there is the question as to what the debtor’s balances really are. 
 
The debtors report released by the Committee last month shows total resort debts to be:

The 2008, 2009, 2010, 2011, 2012 and 2013 debtors included in the current report do not confirm with the reported AGM minutes shown in RED!

A clear example is 2011 where 728,701 euros is used in the report compared to the AGM report of 391,681 euros:

So what is really going on? 

If the Committee cannot even get the numbers right, cannot trace the debtors, cannot be held accountable to hold regular meetings, let alone take the debtors to court then they really need to stand up and assess their positions.

·         For only 6 meetings to be held since July with Resortalia  on debtors in 8 months beggers belief

·         For those held accountable to use incorrect debtors numbers is inexusable or worst shows a miss representation of the previous levels of debtors.

·         For no action taken on tracing owners when the Committee have clearly stated “All outstanding debtors are being pursued” is a dam outright lie to owners.


Enough is enough, all owners need to clearly understand the missmanagement of the situation and take the necessary actions as this months AGM.


Otherwise with 2 MILLION EUROS of debtors before year end and 5 MILLION EUROS of maintenance then the resort is doomed!

Welcome to this months Hacienda Riquelme Resort-wide Owners newsletter.

We aim to continue to show the true state of affairs at the resort rather the ever positive gloss-over comments that come from the Committee.

This month we focus on the Resort Debtors which are now at 1.5 million euros:

As shown above, in the last quarter only 400 cents were collected from the 2008 outstanding debt!

Overall there is NO material debt collections shown over the last 2 years with only small drip, drip, drip, drip collections which shows that no court resolutions have been achieved.


Today's debt is now nearly 4 times the level of 2009 when the global crash was at its peak!





Average Debt per property in debt (excluding PW).




Even though the number of privately owned properties in debt is slightly falling from 319 properties to 250 properties...............


The average debt per debt has increased by 34% per property over the year implying that there are in excess of 250 properties that are not contributing to any community fees at all in 2014:



This rate of increase is alarming and shows the debt position to be deteriorating further as we move into 2015. No wonder Nigel resigned and Ron has clearly stated that we will not seek reappointment in March 2015!

Phases 1 and 5 contribute move debt than any other phases:




Conclusions

Debtors - We need detailed debtors information:

  • How many debtors have finally been traced and replied to their debt outstanding position (xxx out of 250)
  • How many debtors have an agreed documented repayment plan (xxx out of 250)
  • How many debtors have started to go through the court process i.e. court papers raised and court hearing date scheduled (xxx out of 250)
  • How many debtors have a court order for repayment (xxx out of 250)
  • How many debtors have a balliffs order pending i.e. seizure of assets (xxx out of 250)
  • What weekly updates and review occurs for each debtor
  • How often do the Committee review debtors in their Committee meetings as their documented Committee minutes appear not to clearly state this is happening!

Please note that we have previously been informed, by the previous Resort President in charge of debtors at that time, that the majority of debtors have yet to be traced hence the problems we all face today!

Phase Presidents should be congratulated for standing for office however exactly what do they do, if anything, in reviewing and actioning each of the own phase debtors?


Phase debtors without PW or surcharges applied

Resort Budgets - We need to set these on the actual cash collected otherwise we are just building a bad debt problem which will still be paid for in the end.

Polaris World - We now need to seize the town centre building assets as security against the debts owed.

We have previously stated that appropriate action has to take place NOW otherwise debtors will soon exceed 2 million euros - a date that is now not to far away!

This month we focus on costs and the average wage of workers!

Spain increases minimum wage

The Spanish government on Boxing Day approved a EU3 increase to the minimum wage.PM Mariano Rajoy announced the measure following a Cabinet meeting, confirming that the minimum monthly wage now stands at EU648.60.  The major trade unions immediately branded the gesture "insufficient" considering the increase in the cost of living over recent years.

Rajoy himself called the increase "modest", but insisted that it will benefit those already on the wage, as the increase was frozen in 2012, and only came to 0.6% last year. The trade unions have demanded a 12.5% increase for 2015, which would bring the minimum wage to EU725, to be followed by an increase of 10.2% in 2016, which would bring the minimum wage to 2016 in order to address the escalating cost of living in Spain over recent years.

50% of Spain's workers earn under EU1,000 per month


 

Following 5 years of economic crisis, a long recession and austerity policies, almost 50% of Spanish workers earned less than EU1,000 per month while one-third did not even reach the minimum salary of EU645, according to data published by the tax revenue agency, based on tax returns presented last year.

Out of 16.6 million employed last year, 7.7 million had a salary of less than EU1,000, while 34% did not make the minimum salary.

The data included, among others, workers with short-term and part time contracts, almost all youths. In particular, 86% of 39,168 under-18 workers earned less than the minimum salary; while over 1.1 million workers aged 18 to 25, or 74.4% of the total, made less than EU645 a month, or the minimum salary.

According to the data, 16.7 million Spanish workers in 2013 remained below that threshold, out of 26.3 million salaried workers.

HRGR Gardening Costs
Taking into account that the gardeners are a low paid role and with an average of 10 gardeners engaged at HRGR then assuming if they were paid the minimum EU 857 per month then the labour costs of the contract would be 8,570 per month.

This equates to 103,000 euros per year.


So why are we paying 340,000 euros per year?


Of course there are overheads, management costs and third party profit but at what level! Or looking at this another way 340,000 divided by the minimum wage of 857 euros equates to 393 gardeners - don't think we employ anywhere near that number!


Focus, Focus, Focus
As usual owners receive have countless WI Committee emails about policies on dogs, cats, and trees to name a few recent communications.

The hard stuff like driving down costs and what is actually happening on the debtors now reaching 2 million euros, fails to appear, time and time again!

It is as if they cannot see the wood from the trees!

Results to date:
Thank you to all owners that have completed the survey to-date, the response rate has been overwhelming! The summary findings are:


Q1:
Do you believe the Communities Fees that you pay are at the right level?


Q2: Are you willing to pay an extra 30% next year in increased Community Fees?



Q3: Should the Resortalia administration contract be retendered?



Q4: Do you believe the level of security is at the right level?



Q5: Should the buildings be cleaned ............



Q6: Should the Resort President be elected by..........



Q7: Should the 2015 budgets include provision for repainting of the resort buildings?




Q8: Should there be only One AGM for all owners next March to attend?



Q9: Should all material contracts include defined Service Levels of the service to be performed?



Q10: Do you believe the Committee are delivering services at the optimuim level and price?

Overall, the committee has a long way to go to meet owners expectations!
